Conditions of Sale

Please read these Conditions of Sale carefully before using the Race Party Website. By using the Race Party Website, you are agreeing to be bound by these Conditions of Sale.

• The Race Party Website may provide links to third party websites and the products or services of third parties. Race Party disclaims all responsibility and liability in any way. You assess or use of the third party sites is at your own risk.
• The Race Party Website may from time to time display third party advertisements. Such advertisements or may not contain hyperlinks to third party websites. Race Party does not endorse or recommend the goods or services of such advertisers or their websites.
• Copyright in the Race Party Website is owned by Race Party.
• The Race Party Website may contain trademarks or logos of Race Party, other companies or organisations and these are proprietary to the owner(s) of such marks.
• Race Party may at any time discontinue or limit access to the Race Party Website or its content. Race Party may terminate or limit your assess to the to the Race Party Website if you breach these conditions. All disclaimers and limitations of liability by Race Party will survive termination.
• Race Party does not permit outside food or drink (except birthday cakes or similar items approved in advance by Race Party) in the venue. 
• Race Party is not liable for delays, postponements or other circumstances related to or caused by circumstances beyond its control including but not limited to the unavailability of lanes, loss of electricity, inclement weather, scheduling, fire, cyclone or flood. 

Purchasing from the Race Party Website

You may offer to purchase any of the Race Party products described in the Race Party Website for the price specified on the Race Party Website.
Your order must contain your name, phone number, e-mail address, credit card details and any other ordering information specified on the Race Party Website.
Payment must be effected by credit card using the payment system on the Race Party Website.
Confirmation of your purchase will be sent to your nominated email address once your payment for the transaction has been cleared. If you do not receive a confirmation email within two (2) business days please contact Race Party.
You may not cancel an order once it has been submitted and paid, even if a confirmation email from Race Party is still pending.
If you wish to purchase a Race Party product by telephone, post or by visiting the Race Party venue then any such purchase will be governed by these Conditions of Sale (excluding any of the Conditions of Sale that are specific to purchases made using the Website) but including the conditions displayed at the Race Party venue.

Pricing

The prices of the Race Party products shall be the prices displayed on the Race Party Website on the date of your order (inclusive of Goods and Services Tax (“GST”) and any other charges which must be mandatorily disclosed under the Competition and Consumer Act 2010(Cth). All prices displayed on the Race Party Website are quoted in Australian dollars and must be paid in full, except where discounts are offered as detailed on the Race Party Website.

Cancellation due to error or unavailability

You acknowledge that despite Race Party’s reasonable precautions, Race Party’s products may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error, unavoidable circumstances or other oversight. In these circumstances, Race Party reserves the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged.
If a cancellation occurs in accordance with the clause above, after your credit card has been charged for the purchase, Race Party will immediately issue a credit to your credit card account for the amount in question.

Details of conditions applicable to purchase of Race Party products

Details of the conditions applicable to the purchase of Race Party products on the Race Party Website may differ from time to time. Race Party reserves the right to make any changes to the details and Conditions of Sale if necessary to comply with any applicable legislation and to change the details and conditions published on the Race Party Website, without affording notice, provided that this does not materially affect the nature of the Race Party products purchased by you.

Order submission and your agreement to these Conditions of Sale

When you click on the “Pay Now” button you agree to these Conditions of Sale and Race Party will treat the order as confirmed. You are responsible for ensuring the accuracy of your order. Race Party shall supply you, subject to availability, with Race Party Products set out in your order. Race Party shall confirm each order made online via the Race Party Website or by email within two (2) business days.

Security Policy

When purchasing from the Race Party Website your financial details are passed through a secure server.
No transmission over the Internet can be guaranteed as totally secure. Whilst Race Party strives to protect such information, it does not warrant and cannot ensure the security of any information, which you transmit to it. Accordingly, any information which you transmit to Race Party, including your credit card details, is transmitted at your own risk and Race Party shall have no liability to you for any financial or consequential loss or damage suffered by you in anyway whatsoever arising out of or related to your use of this website whether due to negligence, breach of contract, statute or statutory duty by Race Party.
Once Race Party receives your transmission, it will take reasonable steps to preserve the security of such information.

Law and Jurisdiction

These Conditions of Sale shall be governed by and construed firstly in accordance with the laws of the State of Victoria (the courts of which shall have exclusive jurisdiction) and then in accordance with the laws of the Commonwealth of Australia. If any of these Conditions of Sale should be determined to be void, invalid or otherwise unenforceable, such conditions shall be deemed deleted and the remaining Conditions of Sale shall remain and continue to be valid, binding and enforceable.

GENERAL TERMS AND CONDITIONS

Photography Policy

Race Party will, on occasion, take photographs of guests within the venue for a number of purposes not limited to but including:

• mementos for groups and individuals conducting an event
• display on in venue televisions and displays
• training and development purposes.

By entering Race Party you consent for Race Party to take video and images for security and promotional purposes of yourself and, or any child you are responsible for.

Promotional and Advertising Material

By providing your email to Race Party you consent to receiving promotional and advertising material from time to time. You may opt out from receiving this information at any stage.
Photographs or videos taken by guests must be limited to their own attendees and are for personal enjoyment only. Any use or reproduction for commercial purposes, without written permission from Race Party, is strictly prohibited.

Hours of Operation

While the operating hours of Race Party are listed, we reserve the right to on occasion close the venue at times other than advertised.

Refund Policy

Casual Racing and Burnout Sessions

In the event of a missed session or late arrival, no refunds or rain checks will be issued.
Casual Racing and Burnout sessions require full payment at the time of booking. All Casual Racing and Burnout session cancellations are non-refundable. On line bookings are not refundable however we can change reservation times providing at least 72 hours notice is given and subject to availability and price.

Birthday Parties, Meetings and Events

All event bookings require a 50% deposit at the time of booking placement. Enquiries without a deposit are not secured and dates remain open. Upon receipt of a deposit an order becomes Confirmed.

If an event is cancelled more than 6 weeks prior to the event date a full refund of the deposit will be returned to the customer

Events that fall between 6 weeks and 7 days can be rescheduled to another date within 6 months of the original booking date. Events may only be rescheduled one time.

Any bookings cancelled within 7 days of the event date will forfeit all monies paid.

Birthday parties requiring more than one track room

In the event of a booking requiring more than one race track room, a minimum number of 34 guests must be paid for. While groups of between 24 and 34 guests may still be booked to use both track rooms, the minimum guest amount of 34 is still applicable.

Alcohol

No alcohol may not be brought into the venue.
Persons believed to be intoxicated will be refused entry and/or asked to leave the premises. Customers must comply with laws and regulations controlling the use of alcoholic beverages 

Safety

For the safety of all guests and staff, surveillance cameras operate in all Race Party venues at all times.
All children must be accompanied by a parent or supervising adult at all times

Warning. There are some inherent risks in the participation in slot car racing. You should consider this participation an exercise in good judgement and act in a responsible manner while using this venue. 

Responsibility. Adults/carers are responsible for persons under their supervision. 

Staff Direction: You must obey all reasonable verbal or written instructions / warnings given by Race Party staff

Race Party may refuse service or access to a venue based on a customer's inappropriate behaviour or dress attire. No item which, in Race Party’s opinion, may be dangerous, encourage aggressive behaviour or be disruptive is permitted in the venue. 

Footwear must be worn at all times in our venues and we may ask you to remove hats and caps

Race Party may, in its sole discretion, delay, suspend or end a session or suspend or cancel a customer's use of the venue in whole or in part and at any time for any reason without penalty or refund. 

Any photographs, videos or sound recordings taken by you must be for personal use only. Any use, reuse or production for commercial purposes without our express written consent is strictly prohibited and may result in loss or damage to Race Party 

Your image may be taken at any time for security purposes or for use in marketing materials 

All Race Party venues are non-smoking

To the extent permitted by law, Race Party takes all reasonable steps to provide you with a safe and enjoyable experience. However Race Party will not be liable to any person in respect of any loss of or damage to the personal property of, or the loss of life or personal injury to, any person, whether that loss, damage or personal injury is caused by any person’s negligence (including the negligence of Race Party) or otherwise
